Terms of service

Keyday is free for people looking for an agent. Agents pay a subscription. These terms cover both, and the agent sections carry obligations that protect the people whose details agents put into the system.
Agreeing to these terms
Keyday is operated by Ting-Yu Lo, trading as Keyday Australia (ABN 80 599 113 213), based in Victoria, Australia. These terms are an agreement between you and that entity.
By using keyday.com.au or the Keyday CRM you agree to these terms. If you are agreeing on behalf of an agency, you confirm you are authorised to bind it.
Our privacy policy forms part of these terms.
If you are looking for an agent
Keyday is free for you. We are paid by agents through a flat subscription. We never take a share of your transaction and we do not charge referral fees, so no agent can pay to be ranked higher.
What we do. We match your enquiry to an agent who covers your suburb and service, and pass your details to them.
What we do not do. We are not a party to any agreement between you and an agent, we do not provide real estate, financial, legal or tax advice, and we do not guarantee any outcome. The agent is independent of us. Their conduct, advice, fees and results are theirs, not ours.
Check the agent. Agents must hold a licence or registration in their state. You can and should verify that with your state's fair trading or consumer affairs body before engaging anyone.
If you are an agent
Your account. You are responsible for your account, your team's accounts, and everything done under them. Keep your credentials secure and tell us promptly if you think they have been compromised.
Licensing. You warrant that you hold a current real estate licence or registration in every state where you operate, and that you will tell us if that changes.
Accuracy of your profile. Your public profile must be accurate. Do not claim service areas you do not service, results you did not achieve, or credentials you do not hold.
Contacts you upload, and messages you send
This section matters. When you put someone else's personal information into Keyday, you are asking us to hold it on your behalf.
You warrant that:
- You have a lawful basis to collect and hold every contact you add or import, including by CSV
- You have the consent required by the Spam Act 2003 (Cth) before sending any commercial message to them, whether express or reasonably inferred from an existing relationship
- You will record the source of that consent honestly when Keyday asks for it
- You will comply with the Privacy Act 1988 (Cth) in your own handling of that information
Opt-outs are enforced by the platform. Every commercial message sent through Keyday carries an unsubscribe. When someone opts out, Keyday blocks further messages to them from your workspace. You must not attempt to work around that, and you must not use Keyday to send messages to anyone who has opted out elsewhere.
Telephony. Where you send SMS, you connect your own Twilio account and Twilio bills you directly for usage. Keyday is not a party to that billing and does not resell telephony.
You indemnify us against claims arising from your breach of this section.
Subscription and payment
Agent subscriptions are a flat fee per seat and per feature. Pricing does not vary with how many messages you send. Fees are stated on our pricing page and are in Australian dollars.
Subscriptions renew automatically until cancelled. You can cancel at any time and your access continues to the end of the paid period.
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.
Your data
You own the data you put into Keyday. We hold it to provide the service. You can export it at any time, and you can ask us to delete it when you leave.
We do not use one agent's contacts to benefit another agent, and we do not sell agent or consumer data.
Acceptable use
You must not:
- Use Keyday to send unsolicited commercial messages
- Upload contacts you have no basis to hold
- Scrape, resell or redistribute other agents' profiles
- Attempt to access another workspace's data
- Misrepresent your identity, licensing or track record
We can suspend or close accounts that breach this, and we will where consumers are being harmed.
Availability and liability
We work to keep Keyday available but do not guarantee uninterrupted service. We may change or discontinue features, and will give notice of significant changes to paying customers.
To the extent permitted by law, our liability for any claim connected with Keyday is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss, including lost profits or lost business opportunities.
Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of that state have jurisdiction.
